Russ Foster inducted into the American Board of Trial Advocates
The Mike Kelly Law Group, LLC is pleased to announce that Russ Foster was inducted into the American Board of Trial Advocates (ABOTA), at the South Carolina Chapter's annual Black Tie Dinner of February 11, 2010. The ABOTA Foundation was established in 1991 to provide education to the American public about the right to trial by jury and to promote the professional education of trial attorneys. Russ practices law of counsel for MKLG, and throughout his successful career has obtained justice for each of his clients. In addition to earning a reputation as a trusted attorney since he began practicing law in 1985, Mr. Foster is active in the community where he raises his family.

A member of the Board of Directors, Mike, has been involved with the New Morning Foundation for a number of years. Dr. Darden was ultimately responsible for organizing New Morning, a non-partisan private-sector long-term initiative to improve young people's reproductive health education, counseling, and clinical services throughout South Carolina. The Foundation's mission has evolved to in clued people up to age 30. New Morning also supports TellThem! and The South Carolina Coalition for Healthy Families, which advocate for state policies to protect and expand reproductive health education and clinical services.

Glenforest High School Basketball Coach, William Knopf has been named the 2010 Samaritan's Feet Barefoot Coach of the Year. 'Barefoot For Bare Feet' is a movement created by Samaritan's Feet that has gained worldwide appeal and outreach. Coach Knopf demonstrated courage at the highest level by raising thousands of pairs of shoes by coaching 13 games in his bare feet, including the South Carolina State Championship Game and by walking 8 miles barefoot to a game.
Coach Knopf is a former MKLG client; Mike is the 2009-2010 Vice Chairman of the Board of Directors for Glenforest and the parent of a former student.

Medical Malpractice Verdicts and Settlements

We negotiated a $425,000 settlement for a once-active, older client who now has some degree of paralysis due to incorrect medical treatment. Our client was never warned about injecting a newly prescribed medicine before a scheduled surgery to relieve pain from an old injury. Nor did the staff at the hospital where the surgery was performed ask if she had taken any medication earlier that day or perform a blood test that would have revealed the drug's presence. An Horry County jury awarded our client a $3 million verdict in a medical malpractice/wrongful death case. In 2002, our client took his 25 year old wife to the emergency room because of back and abdominal pain. She was diagnosed with a kidney stone, discharged and was scheduled an appointment with a urologist the following Monday. Prior to the urology appointment, she passed away from an indetected infection. The jury found that the death was preventable and that the medical providers did not meet the accepted standard of care in failing to take appropriate vital signs and to perform basic testing which would likely have identified the infection. Personal Injury Settlements and Verdicts

We won a $250,000 settlement for a Kentucky woman who was injured while vacationing in Myrtle Beach, SC. Shortly after arriving, she was sitting by the pool when a piece of roof debris, falling from five stories above, crushed her foot and ankle. Although no amount of money can replace the mobility that she lost or compensate for her pain and suffering, we were able to settle her case just before the lawsuit went to trial. Legal Malpractice Settlements and Verdicts

Our client was a South Carolina woman who suffered debilitating ankle injuries from a motor vehicle accident. We settled for $250,000 against the client's original attorney in a legal malpractice claim based upon the attorney's failure to act in a timely manner – a mistake that prevented our client from recovering damages from the at-fault driver. Social Security Disability / Workers Compensation Settlements

One of our clients, unable to work for more than three years, was denied Social Security disability benefits. During those years, she had lost everything and was living in various shelters. We were granted an expedited hearing on her behalf, a rare occurrence in itself, in which she was found to be disabled and entitled to benefits.

 

In another instance, our client was a former long distance truck driver who waited six years after he became unable to work before applying for disability benefits. By the time he contacted us, his savings were gone. He was doubtful that he would ever receive any benefits based on the horror stories he had heard from other claimants who had been denied. After we helped him navigate an unfamiliar and somewhat threatening system, he was awarded benefits during the actual hearing. That almost never happens.
